  5. LIMITED USE SOFTWARE LICENSE AGREEMENT

  7. This Limited Use Software License Agreement (the "Agreement") is a legal
  8. agreement between you, idevgames.com, and Holmes Futrell. By downloading or otherwise
  9. receiving the software material, which includes source code (the "Source Code"),
  10. you are agreeing to be bound by the terms of this Agreement. If you do not
  11. agree to the terms of this Agreement, promptly destroy the Software.
  12.  
  13. "Distribution" refers to all material included in the logical container of this
  14. license file (e.g. folder, directory, or archive).
  15.  
  16. "Software" refers to all material in the Distribution, and any derivative
  17. thereof, that can be used to control the operation of a computer, directly or
  18. indirectly, including, but not limited to, source code, byte code, object code,
  19. executables, and scripts.  This does not include any images, sounds, movies,
  20. music, models, or other content included in the Distribution.

  22. "Private use" refers to use of the Software on a personal computer owned or
  23. controlled by you.
  24.  
  25. "Educational use" refers to examination and modification of the Software to
  26. better understand the techniques used in it.
  27.  
  28. "Commercial Use" refers to use of the Software resulting in foreseeable
  29. compensation or use in connection with any business activity.
  30.  
  31. "Use" refers to loading into memory, executing, interpreting, installing,
  32. copying, compiling, decompiling, disassembling, recording, compressing,
  33. decompressing, transferring, translating, or otherwise processing the Software.

  35. 1. Grant of License.
  36.  
  37. Holmes Futrell grants to you the right to Use the Software for Private and Educational
  38. purposes. You have no ownership or proprietary rights in or to the Software. The
  39. Software, together with any archive copies thereof, shall be destroyed when no
  40. longer used in accordance with this Agreement.

  42. You agree to use your best efforts to see that any use of the Software licensed
  43. hereunder complies with the terms and conditions of this License Agreement as
  44. well as all laws and regulations of the United States and any other foreign
  45. country in which the Software is used.

  47. 2. Permitted Uses.

  49. Except as prohibited below, you may make any modifications to the Software and
  50. recompile it for your own Private or Educational Use. You may make modifications
  51. to parts of the Distribution other than the Software only to the minimum extent
  52. necessary to allow your modified version(s) of the Software to operate. You
  53. shall not obtain any ownership, copyright, proprietary or other interest in or
  54. to the the Distribution, or any part thereof.

  56. 3. Prohibited Uses.
  57.  
  58. Commercial Use of the Distribution, or any part thereof, is prohibited.  You may
  59. not modify the Software to communicate with other programs except for debugging
  60. or analysis purposes. You may not allow your modified version(s) of the Software
  61. to communicate with the unmodified Software. You may not disclose the
  62. Distribution, or any part thereof, to others in any form, original or modified.
  63. All other use of the Distribution, or any part thereof, not explicitly allowed
  64. above is prohibited.

  66. 4. Copyright.

  68. Holmes Futrell shall retain unlimited transferable and commercially exploitable rights
  69. to the Distribution.  Holmes Futrell implicitly grants "idevgames.com" irrevocable
  70. perpetual non-exclusive distribution rights for the Distribution.  Except as
  71. explicitly allowed hereabove, you may not reproduce, copy, or disclose to
  72. others, the Distribution or any part thereof.

  74. 5. No Warranties.
  75.  
  76. THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR
  77. IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS
  78. FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR
  79. COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER
  80. IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN
  81. CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.

  84. copies of the Distribution and works derived therefrom.
